Tarsil.pk reserves the right to refuse membership access to any business considered to have provided false, inaccurate or misleading information during registration. By using the Tarsil.pk platform, you agree to use the dispatch software and drivers app as it was intended without malicious intent. You are responsible for all actions taken on behalf of your account. Any changes made to your Tarsil.pk account is ultimately your responsibility. Should it be discovered that you acted with ill will or malicious intent against the Tarsil.pk platform resulting in damages, your membership account may be suspended and legal action may be taken against you and your company.
The Website is owned by Binyte, Lahore Pakistan and the User acknowledges that Binyte or its licencors are the proprietors of all intellectual property subsisting in, pertaining to or used on the Website including, without limitation, patents, inventions, copyright, trademarks, goodwill and trade secrets. Permission is given for the downloading and temporary storage of one or more of these pages for the purpose of viewing on a personal or business computer. Our documents are absolutely free for business and personal use and for that purpose may be edited and printed. The contents of this site are protected by copyright under international conventions and, apart from the permission stated, the reproduction or retransmission of the contents of this site is prohibited without the prior written consent of Tarsil. Important Note! That also means that the content may not be uploaded to community sites or forums and may not be published in any form whatsoever. The User makes use of this Website at the User’s own risk. Notwithstanding anything to the contrary contained in these Terms and Conditions, Tarsil shall have no liability for any loss, damage, cost, claim or penalty of whatsoever nature, including but not limited to indirect and consequential damages and loss of profits, however arising out of or in connection with these Terms and Conditions or the Website and whether caused by latent or patent defects in the Website, the use of the Website and information contained on the Website or otherwise.
The User hereby indemnifies Tarsil and holds it harmless against any and all liability, loss, damage, penalty, cost or claim of whatsoever nature suffered by any third party in relation to any act or omission by the User or the User’s members, employees, representatives, agents or assigns or any third party in relation to the Website and the use thereof by the User, and/or arising from the provisions of these Terms and Conditions.
The User assumes all responsibility and risk for the use of the Website and Tarsil disclaims all liability for any loss, injury, damage, cost, penalty or claim resulting from the use of the Website, whether direct or indirect, and whether or not Tarsil has been advised of or has knowledge of the possibility of such loss, injury, damage, cost, penalty or claim resulting from the use of the Website, whether direct or indirect.
None of the material contained on Tarsil.pk or through the Google Play or iTunes marketplace related to the Tarsil platform and applications may be reverse-engineered, disassembled, decompiled, transcribed, stored in a retrieval system, translated into any language or computer language, retransmitted in any form or by any means (electronic, mechanical, photo reproduction, recordation or otherwise), resold or redistributed without the prior written consent of Tarsil.pk. Violation of this provision may result in severe civil and criminal penalties.
All payments made to Tarsil for services offered through Tarsil.pk will be processed by Binyte and are considered final and non-refundable. Payments include membership fees (paid by the user), text message credits and invoice payments. Credits purchased will be held by Tarsil indefinitely and are non-refundable. Credits can be used to create new delivery tickets, send SMS text messages between members (Users) customer and driver through the Tarsil platform. If a customer would like to dispute a bill or deduction of credits, please contact our billing support through your Tarsil account.
Users are limited to one active user account per company and are prohibited from creating multiple user accounts without prior written permission from Tarsil. A user account is defined as an account created through the Tarsil sign up form that has been validated through email by the user or has an active status. Operator accounts and driver accounts are not considered user accounts. Creating multiple user accounts can lead to an account suspension without notice and a permanent ban from the Tarsil platform. If such an event shall occur, any remaining credit in the users account and any time pending in the users pre-purchased membership will be forfeited and considered non-refundable.
Disputes and Arbitration
If any dispute arises between the Parties relating to the application, interpretation, implementation or validity of this agreement, the Parties agree to resolve the dispute by mutually selected 3rd Party arbitration at Lahore using the Arbitration Rules of Major Act, Pakistan. The parties agree that the Arbitration Rules give the parties a fair opportunity to present their case and respond to the case of the other side. The arbitration shall be held in Lahore, Pakistan and shall proceed in accordance with the provisions of the Arbitration Act Pakistan. Judgement upon the award rendered by the arbitrator may be entered in any civil court having jurisdiction.
